Wills
Estate planning is the best way to look after your loved ones after death. A Will is a legal document that can ensure your assets are distributed to your beneficiaries as you wish.
It is most important when you have infant children (under the age of 19) as a Will can appoint a Guardian for their care. It also enables you to appoint a person known as your Executor, to carry out the instructions of your Will. An Executor must be someone you trust and someone who can carry out the task. As such, 2 or more persons can be appointed and/or an alternate can be named. Tong & Mow Notaries are certified and insured in providing Executor services for your consideration in the event you are unable to name someone or an alternate.
Without a Will, BC’s “intestate” laws apply where the process to get an “Administrator” appointed, as there is no Executor. This process is time consuming and costly. You would have no control over who gets appointed, and which specific assets your beneficiaries would get.
As each person’s assets and surrounding loved ones are unique, we meet with you in person to take instructions about your wishes, and provide legal advice to help you have a better understanding of your decisions.
Powers of Attorney
A Power of Attorney is a legal document that appoints another person (the “Attorney”) to make legal and financial decisions for you (the “Adult”). It can be a simple, quick and affordable way to ensure your affairs are taken care of in the case of travel, physical or mental incapacity.
The scope of your Attorney’s power is determined by you. A Specific Power of Attorney identifies your Attorney’s authority(ies) and can be given an expiry date, whereas an Enduring Power of Attorney ensures that powers granted survive once you become mentally incapable. The Adult must be at least 19 years of age, and should be someone you trust with the powers you grant them.
Regardless of age or health, it is important to have a Power of Attorney. It is a preventative measure that can give you peace of mind that your affairs are in order when accidents or degenerative diseases such as Dementia occur, making it too late to do so. This document can be given an expiry date, or be cancelled in the future provided you have mental capacity.

Representation Agreement
A Representation Agreement is a legal document that appoints another person to make health and personal care decisions for you.
It is a preventative measure to ensure your appointed person is the one that makes decisions for you if you are unable to due to an accident, illness or disability. This document can be given an expiry date, or be cancelled in the future provided you have mental capacity.
There are 2 types of Representation Agreements. One grants full authority while another provides less authority for “routine management” and some financial decision making power due to limited mental capacity.
With all our Representation Agreements, we meet with you in person to discuss if a Representation Agreement would be ideal for you and to answer any concerns you may have.
